As it did not see any danger that would require the granting of urgent protection, the 2nd Chamber of Commercial Law of the Court of Justice of Santa Catarina denied the request of a Pentecostal church for an evangelical church to refrain from using a similar name.





The Pentecostal God is Holy Church went to court against the Evangelical God is Holy Renewed Church, alleging that the similar names have confused the faithful, who would be making donations and attending the changed shrines. In the action, there was a request for urgent protection, which was denied in the first instance.



The Pentecostal church appealed, claiming Portugal Mobile Number List that the risk arises from the recent expansion of the evangelical church, "which also copies the layout and forms of dissemination of the aggravating party in an attempt to gather believers with the branding confusion". The appeal, however, was unanimously denied by the TJ-SC.



According to the rapporteur, judge Newton Varella Júnior, "the allegation that there are believers who made a donation and attended another church by mistake was not even corroborated by statements to that effect, and it does not even seem credible to me that people would confuse an evangelical church with a Pentecostal one until even as to the location of each one".



Thus, the rapporteur concluded that there is also no demonstration that the expansion plans of the evangelical church, "also unproven", would be capable of affecting the number of believers in the Pentecostal church.







"The gathering of believers with the aim of increasing the collection of donations is not the purpose of the appellant, who appears to act in this case with almost commercial intentions, preventing another church from being established. This all demonstrates that there is no danger that requires the granting of urgent protection required, especially because, in the end, the two churches aim for the same objective", said the judge.
